Terms of Service

Hey AI, it's Me! is operated by Scott Harlan, sole proprietor (Washington, USA)(“we”, “us”). These terms are an agreement between you and us. By requesting a score, creating an account or otherwise using the service, you agree to them. If you do not agree, do not use the service.

The service

The service measures how AI assistants respond to questions about a brand and reports the results as scores. Scores are estimates built from AI-generated responses, which vary from one request to the next and change over time. They are for information only and are not a prediction or guarantee of any business result. Our methodology describes how we calculate them.

Your account

Requesting a score creates an account for the email address you provide. You sign in through a link we send to that address. You are responsible for the security of that email account and for activity under your account.

Acceptable use

  • Submit only websites that you own or are authorized to have assessed. By submitting a website, you confirm that you have that authority and you direct us to access it on your behalf.
  • Do not scrape, bulk-copy, resell or republish our results. Do not use automated means to request scores.
  • Do not circumvent rate limits, interfere with the service or use it in violation of any law.

Ownership and licenses

We own the service, including the site, the scoring methodology and the software behind them. We grant you a limited, non-exclusive, non-transferable license to use your results for your own business purposes. You keep ownership of what you submit. You grant us the right to use it to provide the service, and to use aggregated or de-identified data to operate and improve the service.

Paid plans

This section applies if you buy a paid plan. The free score requires no payment details.

  • Paid plans are subscriptions. They renew automatically at the price and interval shown at checkout until you cancel. We do not offer a free trial of a paid plan.
  • You may cancel at any time online through the customer billing portal. Canceling stops future charges.
  • Payments are non-refundable, except where the law requires otherwise.
  • Payment is processed by Stripe. We do not receive your full card number.
  • Prices exclude taxes. Where we are required to collect sales or use tax, we will add it at checkout.
  • If we change the price of your plan, we will notify you before the change applies to your subscription.

Other brands in results

Results may name other brands, including competitors, because AI assistants mentioned them. Those references report what the assistants said. They are not our statements about any brand, and they do not imply that any named brand is affiliated with us or endorses us. To ask us to review how a brand appears in results, email scott@heyaiits.me.

Suspension and termination

You may stop using the service at any time and may ask us to delete your account as described in our Privacy Policy. We may suspend or end your access if you breach these terms or if we need to protect the service or other users. Sections that by their nature should survive termination will do so.

Disclaimer of warranties

The service and all results are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that results are accurate or complete, or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for all claims relating to the service will not exceed the greater of US$100 or the amount you paid us in the 12 months before the claim arose.

These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud, gross negligence or willful misconduct.

Indemnity

You will defend and indemnify us against third-party claims arising from the websites and information you submit or from your breach of these terms.

Governing law and venue

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. The state and federal courts located in Washington have exclusive jurisdiction over any dispute, and you consent to jurisdiction there. Either party may instead bring a qualifying claim in small-claims court.

Changes to these terms

We may update these terms, and we will post the new version here with a new effective date. If a change is material, we will also email account holders before it takes effect. Changes apply only from their effective date. If you do not agree to a change, stop using the service.

General

These terms and the Privacy Policy are the entire agreement between you and us about the service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a transfer of the business.
